DMCA Policy

We are committed to responding to clear notices of alleged copyright infringement that comply with the DMCA. Filing a DMCA Infringement Notice

DMCA Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled, you may file a counter-notification with us. To be effective, a counter-notification must be a written communication provided to our designated Copyright Agent that includes substantially the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

  • Identification of the material that has been removed or to which access has been disabled: And the location at which the material appeared before it was removed or access to it was disabled on the Aperol Spritz Recipe website.
  • A statement under penalty of perjury: That the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • The subscriber's name, address, and telephone number.
  • A statement that the subscriber consents to the jurisdiction: Of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which Aperol Spritz Recipe may be found, and that the subscriber will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • The subscriber's physical or electronic signature.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the person who submitted the original DMCA infringement notice. If we do not receive notice from the original complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material on Aperol Spritz Recipe within 10-14 business days, we may replace the removed material or cease disabling access to it.
